This article points out one of the ways the development of these new technologies has altered the boundaries of copyright, specifically by enabling copyright holders to strategically expand the scope of protection through the strategic use of Digital Rights Management (hereinafter, DRM). After a brief overview of these technologies and their contribution to the development of online markets for copyrighted works, the article discusses the risks of using DRM as a means of stretching the legal protection conferred by Intellectual Property law.

As a potential solution to such problem, the article looks at the role of the courts and the approach embraced vis a vis specific cases of abuse of DRM in the copyright context. . . . The article then concludes recommending a two-fold approach to the assessment of the legality of such practices, where antitrust analysis and IP principles are intermingled, proposing a legal test to facilitate this complex assessment.

Investigators Still Searching For Clues in Deadly Pompano Beach ...

A 28-year-old Connecticut woman plummeted to her death while parasailing in Pompano Beach when the harness that attached her to the sail failed. The woman was riding tandem with her 31-year-old husband when she dropped some 200 feet into the ocean. After being rushed to Broward Health North, she was pronounced dead.

Investigators from the Florida Fish and Wildlife Conservation, the U.S Coast Guard and the National Transportation Safety Board (NTSB) are looking into the tragic accident, which once again has spurred lawmakers and government leaders to call for oversight of an industry that is virtually unregulated.

According to The Miami Herald, all you need to operate a parasailing business in Florida is a boat, insurance, a licensed boat captain, and some equipment. There are no federal or state laws that govern parasailing, no inspections, and no special training required for parasail operators. Experts suspect that either harness malfunction or operator error caused this deadly accident.

The Mayor of Pompano Beach said that he called for lawmakers to enact parasailing regulations after an accident took the life of a 15-year-old girl in 2007, but claims his efforts ?fell on deaf ears.? One legislative insider blamed the dearth of any parasailing regulations on lawmakers connected to the tourism industry and on those who believe that any directives would be ?too much government.?

Sadly, the victim had called her father the morning of the accident, expressing how excited she was to go on her first parasailing excursion. ?It was the last time I spoke to her,? he told the Miami Herald.

Texas jury awards nearly $1M to West Nile victim

CUERO, Texas (AP) ? A Texas jury has awarded nearly $1 million to a Union Pacific worker who sued the railroad after claiming he was infected with West Nile virus while on the job.

A DeWitt County jury on Thursday found Union Pacific partially liable for Billy Nami contracting the virus in 2008. His attorney, Michael Sheppard, says Nami was sent to work in a grassy, swampy area along the Texas coast swarming with bugs after Hurricane Ike.

Sheppard says Nami was never warned about the presence of West Nile and wasn't given repellant. Sheppard says jurors assigned 80 percent of the negligence to Union Pacific.

The jury awarded the 62-year-old Nami $980,000 in damages.

Union Pacific spokeswoman Raquel Espinoza said the Omaha, Neb.-based railroad was disappointed by the verdict and plans to appeal.

You Can Learn A Lot About Investing Just By Hitting The Gym ...

If you go to the gym, you already know that there is a lot more that goes on there than pushing weights and sweating buckets.?

But what you may not realize is that you can learn a great deal about investing by simply observing what goes on with all the Iron Men and Women surrounding you.? Here are 7 of the most important secrets I picked up at my local sports center:

1.Get the Right Job Done

Many people go to the gym because they want to work out and stay healthy.? But sometimes it seems like most of the people are there to socialize more than sweat. ?

While investing isn?t really a social activity, it often morphs into something other than a way to build and maintain wealth.

Do you ever invest in something because it?s exciting or because your friends did?? Did you ever invest in something (like Facebook) because you were afraid of being left behind or looking dumb if you didn?t participate?? Did you ever extend a loan to a friend because you wanted to be nice??

Each of us have done some or all of the above (including myself) and they are all mistakes.? When it comes to investing, remember why you are there and what your goals are.? Then, invest accordingly.? You?ll have to work hard at it but endeavor to keep your emotions and your money far apart.

2. Ignore Insider tips & Shortcuts

I remember sitting on my stationary bike or running on the treadmill and listening to the people on my right and left as they shared weight training and weight loss secrets.? Even though I saw lots of people share tips, I rarely heard any two people share the same hush-hush tidbit. ?

Everyone had their own ideas about workout success.? But when it comes to being fit, I don?t think there really are any secrets.? If you want to be healthy it?s a question of energy in vs. energy out.? Diet and Exercise.? Just do it? Simple.?

It?s no different when it comes to money.? In order to build wealth, you have to watch your spending, save well and invest wisely.? Sure there is some learning involved but that?s the easy part. ?

Lack of understanding isn?t what stands in the way of most people?s financial success. It?s the willingness to do the hard work every day that gets us off track.? Many of us look for the short cuts to wealth and when we do so, it usually ends up badly. ?

3. You may not need a gym or personal trainer

Some people do need a gym or trainer to actually work out but not everybody does.? It took me a few years to realize it but I finally understood that I really didn?t need a gym.? I happen to be pretty self-motivate when it comes to exercise (food is another story unfortunately).

Since I mainly used dumb bells and ran, it didn?t cost much to buy everything I needed to work out at home.? More than saving money, I was interested in saving time.? I was spending more time getting to and from the gym than I spent working out and I was tired of it.?

Likewise, you may or may not need a financial advisor.? Not everyone does.? If you do your own research, call your own shots and are happy with the results, why on earth would you need an advisor?? Assess your situation objectively and make sure you really need what you are paying for.?

4. Strategy

When I first joined the gym, I was interested in losing weight.? I worked out like a fiend and became a very fit fat guy.? What I really needed was to focus on my diet.? Hours at the gym were never going to give me the result I needed.

When it comes to investments the same principle applies.? Let?s say your objective is to save for retirement.? This is a long-term objective which requires long-term thinking and long term investments.? If you make risky investments in search of a quick score, you are barking up the wrong tree.? Speculation is risky.?

If you speculate you are taking on undue risk needlessly.? While it would be nice to make a big score it?s just not that important.? What is important is having enough money to retire when you are ready to do so.? Make sure you invest accordingly.?

5. Make sure you know how to use the equipment

There is nothing worse than seeing someone misuse equipment at the gym.? They risk hurting themselves and others and it?s a frightening spectacle. ?

When you invest, are you certain you know which investments to select and how to use those financial tools? This point is connected of course to the point above about strategy.? Long-term investments like mutual funds and ETFs require a different approach than individual stocks.? Whatever your strategy is, make sure you use the right investments correctly.

6. Results Take Time

Years of working out never got me an invitation to compete in a Mr. Universe contest but it has helped me stay healthier than I otherwise would be. And even the modest results I saw weren?t immediate.? It took a while before I stared seeing benefits from all that pushing and pulling, running and jumping.? There were several times when I thought I was wasting my time and considered giving up. ?

Many people get impatient when it comes to investing too.? This is extremely dangerous because it leads to making risky investments in the hopes of getting quick returns.? Of course speculating doesn?t always lead to big losses ? but given enough time, it does.?

7. Don?t Expect Perfection

?You can?t be an ?animal? every time you suit up and show up.? Some days, you just don?t have the energy and the best you can do is go through the motions.? That?s OK.

When it comes to investing, you have to expect to get it wrong sometimes.? You have to make decisions about a future you don?t have any certainty about.? If you aren?t willing to see your account values decline from time to time, you?ll find it hard to stick with your strategy.? Instead, you?ll jump in and out of the market based on your intuition and feelings.? There is nothing wrong with having a strategy which guides you in and out of the market at different times.? Not everyone needs to ?buy and hold?.? I don?t.

But you must use an investment approach even though it?s imperfect.? And you must understand that no investment approach is perfect.? No matter what you do, there will be times that you?ll be disappointed.? That comes with the territory and you have to be willing to stay at it even though it may not be fun at times.

I learned a great deal about investing from the years I spent schlepping down to the gym.? The main message is that investing, like working out, is not a ?one size fits all? enterprise.? But success is very much dependent on being persistent.? Suit up, show up and do the work.?

UK inflation in surprise rise to 2.6 percent

LONDON (AP) ? Official figures show that Britain's benchmark inflation rate unexpectedly rose in July, following a run of declines.

The Office for National Statistics said Tuesday that consumer price inflation rose from 2.4 percent in June to 2.6 percent in July. The market consensus was that inflation would fall to 2.3 percent.

It said airfares, clothing and footwear were largely behind the increase.

The government's official target is to hold consumer price inflation at around 2 percent. The rate has declined from a peak of 5.2 percent in September.

Retirement Plan Participants Display Conflicting Investment ...

The prolonged economic downturn has sapped investor confidence that they will not have enough assets for retirement, resulting in conflicting attitudes and behaviors among retirement plan participants, who at once say they are self-directed investors, but admit that their knowledge about investing and financial products is wanting.

Spectrem Group?s DC Participant Insight Series 2012: Attitudes and Behaviors of Retirement Plan Participants finds that more than three-quarters (77 percent) of plan participants surveyed are concerned about having enough money set aside to retirement, while 70 percent are concerned about being able to retire as planned. Less than half (42 percent said they fully expect to have sufficient income to live comfortably in their senior years.

But a majority of plan participants are not seeking the advice of plan providers or financial advisors. Fifty-seven percent said they make their own investment decisions, while 28 percent said they only consult with an advisor in the event of a specific need or event, such as saving for college or retirement. Oddly enough, just under four-in-10 across all age levels said they liked to be actively involved in the day-to-day management of their investments. About the same percentage of those up to age 50 say they even enjoy investing and that it is something they do not want to give up.

And yet 46 percent of those surveyed said they are not very knowledgeable regarding finance and investments. Just over one-third (38 percent) said they are fairly knowledgeable. Of those admitting they are lacking in financial and investment knowledge, the highest percentage were under the age of 35. Those between 35-49 were the most likely to consider themselves just fairly knowledgeable.

This perhaps explains why 49 percent of plan participants surveyed described their risk tolerance as moderate. But just over one-quarter (27 percent) said they aggressively seek high returns and are willing to place a significant portion of their investments at risk. This attitude is especially prevalent amongst those ages 35-49, 32 percent of whom describe their risk tolerance as aggressive. Perhaps this age group feels a more urgent need to ?catch-up? due to either losses suffered in the wake of the economic collapse or failure to begin saving early enough to have amassed significant retirement assets.

Women, not surprisingly are much more likely than men to describe their risk tolerance as moderate (57 percent vs. 42 percent), while men are more than twice as likely (36 percent vs. 16 percent) to say they are more aggressive investors (they are also more likely to claim solid financial knowledge).

Also not surprisingly, almost half (49 percent) of those over 50 and up say it is more important that they protect their principal than grow their investments. This is also important to more than one-third (37 percent) of those under 35. But more than four-in-10 of those up to the age of 49 said they are willing to take a significant investment risk on a portion of their investments to earn a higher return.

The Family Leader Hits a Home Run with Inaugural Summit | The ...

The Family Leader organization held its inaugural ?Family Leadership Summit? over the weekend and by all accounts, the event was a rousing success. Luring 2012 Iowa Caucus winner Rick Santorum, 2008 Iowa Caucus winner Mike Huckabee, and Texas Governor Rick Perry to the event was quite a coup. Their presence resulted in a sellout crowd.

Perhaps even more surprising to me was the presence of Iowa Congressman Steve King and U.S. Senator Chuck Grassley. Although they appeal to a lot of the same people, King is not exactly bosom buddies with Bob Vander Plaats, the CEO of The Family Leader. Grassley, often dismissed by the BVP crowd as an ?establishment? Republican, delivered one of the strongest speeches of the entire event.

The Family Leadership Summit received another boost when Fox News made a late decision to air part Mike Huckabee?s weekly Saturday night program live from the event. That was due to Saturday morning?s announcement of Paul Ryan being chosen as Mitt Romney?s running mate. The nationwide publicity was another nice benefit for Vander Plaats? group.

Here are some of my thoughts on event:

Unanimous Praise for Paul Ryan: All the featured speakers heaped praise on the vice-presidential hopeful. That?s not really a surprise. Ryan is beloved by grassroots conservatives and people like Steve King and Rick Santorum worked with Paul Ryan in Congress. They all obviously think very highly of the Wisconsin congressman.

Promoting Mitt Romney: Several speakers encouraged the crowd to get behind Mitt Romney. Some social conservatives in Iowa are having a hard time warming up to the GOP nominee-to-be, but Saturday?s event might have helped allay some of those fears.

Production Values: The Family Leader scores an A-plus for this. They put in a lot of effort into making the event look good. During each speech, pictures of the person at the podium were displayed on two of the large screens above the stage. It was a nice touch that greatly enhanced the visual aspect of the event. The package introducing the ?Vote No on Wiggins? announcement was also very interesting and well-produced. Nice job to all involved.

Most Interesting Speech: I thought best-selling author Joel C. Rosenberg delivered a fascinating speech. It was funny, intriguing and thought-provoking. To hear how this man of Jewish ancestry became an evangelical Christian was extremely interesting. Rosenberg?s speech made me want to go buy some of his books, which was probably part of his goal.

Strongest Speech: Surprisingly, it came from Senator Chuck Grassley. Never a master of oratory skills, Grassley served up a huge helping of conservative red meat. For this audience, it was the perfect speech:

?We tend to be apologizing too often. And I?ve come to the conclusion that I?m not going to be apologizing about the exceptionalism of America. I?m not going to apologize about the constitutional basis for America. Because if you have a living constitution, you have a dead constitution because if it?s always that?s always evolving, it?s a constitution that makes Congress and the president supreme and not the Constitution of the United States, the supreme law of the land.?

?Some basics that we must emphasize: Life begins at conception, without apology. Gun ownership is a fundamental right, without apology. Choice in education ought to be a right of any parent, without apology. Freedom of religion, yes. Secularism, no. Without apology. And any minister ought to be able to say from the pulpit in a constitutional way, and not violating IRS rules, to say anything and do anything that Jesse Jackson can do from the pulpit, without apology. We deserve ballot credibility. Voter ID, without apology. We do not have to apologize for America supporting Israel.?

There was more. And it was very good.

Most Provocative Statement: ?The mark of the beast is not going to be 666, it?s going to be a rainbow.? ? Jan Mickelson, WHO radio host, during a media panel

Funniest Line: ?I was the frontrunner in the presidential campaign. I told some folks earlier today out at the state fair, it was one of the most exhilarating three hours of my life?? ? Rick Perry

The ?Vote No on Wiggins? Campaign:?It?s no surprise that Vander Plaats would again take the reigns on an effort to oust one of the Supreme Court justices who thrust gay marriage on the state. He assembled a strong team again, including our new RNC National Committeewoman Tamara Scott and longtime activist Chuck Laudner, who played a crucial role behind the scenes two years ago. Rick Santorum also pledge to assist in the effort. They?ve got the right people in place to make it work, but it will be a more difficult fight this year.

Biggest Applause: By far, that was for Mike Huckabee when he was introduced. This crowd absolutely loved the 2008 Iowa Caucus winner.

Former presidential candidates: I thought all three delivered pretty good speeches. Not surprisingly, Rick Perry?s was the worst of the three. He?s just not a strong public speaker. Mike Huckabee?s was more of a Sunday sermon than a political speech, but it was well done. Santorum just shredded Obama?s recent policies, which subverted our Constitution.

Overall: There are plans to make this summit an annual event. The Family Leader will be hard-pressed to top the inaugural one.

I work hard all year long writing stories, and writing articles. But there are projects that mean a lot to me. And one of those projects that mean the most to me is the Free Summer YA eBook Exclusive Series to Smashwords.

Why do I work so hard on a bunch of free eBooks? Literacy in the Black community is extremely poor. Many of the young brothers and sisters that are attending high school are reading at a fifth or sixth grade reading level these days.

In between the two months from the last day of school to the first day of school of the new school year, most children?s reading skills fall off. Some even regress to the point that they fall back four or five reading levels.

Many parents, especially those in the inner city don?t understand that kids need to keep reading to maintain their literacy. Moreover, they need to keep reading to keep their grade point averages up.

Kids who read regularly have larger vocabularies. They speak more articulately and are better creative writers. They do better in school. They do better on PSAT and SAT exams later on, and they?re better prepared to compete in college.?

When I was younger I used to use the downtime of summer to read comics, magazines and newspapers. That kept my brain stimulated until school started in September. And when I returned to school then I was ready to tackle the classwork (well, everything except algebra. That class was a pain in the ass, failed it four times) that was presented to me.

I don?t want children?s academic skills to fall off. I don?t want them to get discouraged and drop out. So I try to offer material to readers ages 11 and up during the summer. Middle school is a place where children are the most vulnerable to their academic skills stagnating or declining. It?s a place where we lose many a child, especially Black males to the streets for good.

I feel if I can get kids excited about reading and learning about things like screenwriting, maybe it?ll help them keep them in school. Maybe they?ll even see writing or screenwriting as a career path to pursue.

I know most tweens and teens do most of their reading with the PC and other hand-held devices like Nooks, Kindles, ipads and even ipods and cell phones these days. They take these devices everywhere, even to the bathroom. So there?s always an opportunity to read on them.

I also know books are expensive, and eBooks are expensive too. And I know a lot of families are on limited incomes so they don?t have the money to purchase eBooks or paperbacks. So I try to offer a variety of new titles for free so younger readers can have access to reading materials throughout the summer.

I also offer other exclusive titles on Kindle over the year during weekends so readers can have access to reading material throughout the year. Reading should be an everyday thing, and I want to get people passionate about reading something every day. Whether it?s a blog, an eBook, or a paperback, the more a person reads the more they learn.

There is something to be said about being able to do the work you love.

We found our ?love? when we began real estate investing. In the beginning we ?worked? 7 days a week on our RE Investing business, but we didn?t think of it as work because we enjoyed it so much. We immersed ourselves in learning all aspects of RE Investing.

But with all good things, there are obstacles too.? Today we share some of our most recent challenges and how we dealt with each one.? Even if you are not a real estate investor, we think you will find the information helpful.

?We want to thank each of you for being a loyal listener of our podcast.? We appreciate you very much!?For the first 100 episodes of ?Connie and Sheila Talk? our goal was to produce and publish high quality, content rich episodes each week. We did this for over hundred episodes and now we are changing things up a bit.

We discovered the best way for us to learn about a topic is to write about it.?Since the real estate market is picking up we want to be ready for the up-trend.? To do this, we must prepare and learn as much as we can because it will be a brand new market with brand new rules and brand new players.

As we learn more, we will share what we learn through our podcasts and blogging and we are still committed to producing/publishing high quality content.? So what?s changing?

We might blog more than podcast and we might not produce content on a weekly basis.? However, please understand, our goal is to share good & relevant material to benefit you, our listener. If you are not an investor don?t go away. Just like our tagline says ? we talk about Real Life and Real Fun stuff too, and that won?t change!
